TABLE OF CONTENTS

1. AGREEMENT TO TERMS

 These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Boomf Gifts Ltd, doing business as Boomf ("Boomf," “we,” “us,” or “our”), concerning your access to and use of the https://boomf.com website and any related media forms, channels, mobile website, or mobile application (collectively, the “Site”).

By accessing or using the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree with all terms herein, you must immediately discontinue use of the Site.

Supplemental terms and policies posted on the Site from time to time are incorporated herein by reference. We may update these Terms, and continued use of the Site constitutes acceptance of such changes.

International Use Notice: The Site is intended for UK, EU, and US users. Access from other jurisdictions is at your own initiative, and you are solely responsible for compliance with local laws.

Minor Users: Users under the age of 18 (or legal age in your jurisdiction) must obtain parental or guardian consent prior to using the Site (see Section 3 for User Representations).

 

2. INTELLECTUAL PROPERTY RIGHTS

All content on the Site, including text, graphics, logos, images, audio, video, software, and the Boomf Marks, are the property of Boomf or its licensors. You may access the content solely for personal, non-commercial use.

You may not copy, reproduce, republish, upload, post, transmit, sell, license, or otherwise exploit the Site or its content without our express written permission.

All rights not expressly granted to you are reserved. See Section 5 for Prohibited Activities.

 

3. USER REPRESENTATIONS

  • By using the Site, you represent and warrant that:

    • All information provided is true, accurate, current, and complete;

    • You will maintain the accuracy of registration information;

    • You are of legal age to use the Site, or have obtained parental consent if a minor;

    • You will comply with all applicable laws, regulations, and these Terms;

    • You will not use the Site for fraudulent or unlawful purposes.

    Failure to comply may result in suspension or termination of your account (see Section 12 for Termination).

 

4. USER REGISTRATION

  • Certain Site features may require registration. You agree to:

    • Provide accurate, current information;

    • Keep your password confidential;

    • Be responsible for all activity under your account;

    • Notify us immediately of any unauthorized use of your account.

    We may reclaim or change usernames deemed inappropriate or misleading.

 

5. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those specifically endorsed or approved by us.

As a user of the Site, you agree not to:

  • Systematically retrieve data or content to create a collection, compilation, database, or directory without written permission;

  • Trick, defraud, or mislead us or other users, including attempts to obtain passwords;

  • Circumvent, disable, or interfere with Site security features;

  • Disparage, harm, or otherwise abuse Boomf or the Site;

  • Use information to harass or harm others;

  • Misuse support services or submit false reports;

  • Use the Site inconsistently with applicable law;

  • Engage in unauthorized framing or linking;

  • Upload or transmit viruses, Trojan horses, excessive capital letters, or spam;

  • Engage in automated use such as bots or scraping;

  • Delete copyright or proprietary notices;

  • Impersonate another user;

  • Upload passive or active tracking mechanisms, spyware, or web bugs;

  • Interfere with Site operation;

  • Harass employees or agents;

  • Bypass Site access restrictions;

  • Copy, adapt, decompile, disassemble, or reverse engineer Site software, except as permitted by law;

  • Use purchasing agents or automated accounts to make purchases;

  • Use the Site to compete or generate revenue without authorization;

  • Advertise or sell goods/services;

  • Sell or transfer your profile.

We may, at our sole discretion, edit, re-categorize, or delete contributions at any time. See Section 6 and Section 8.

 

6. USER GENERATED CONTRIBUTIONS

The Site may allow you to create, post, submit, or transmit content, including text, images, videos, audio, and other materials ("Contributions").

You represent and warrant that your Contributions:

  • Do not infringe the rights of others;

  • Are owned by you or you have necessary licenses and permissions;

  • Have consent from identifiable individuals included;

  • Are accurate, not misleading, and lawful;

  • Are not spam, obscene, harassing, or otherwise objectionable.

7. CONTRIBUTION LICENSE

By submitting Contributions, you grant Boomf a worldwide, royalty-free, sublicensable, perpetual, irrevocable license to use, copy, modify, distribute, display, and exploit such Contributions for any purpose, commercial or otherwise.

You retain ownership of your Contributions but waive moral rights to the extent permitted by law. See Section 6 for User Generated Contributions.

 

8. SUBMISSIONS

You acknowledge that any questions, comments, suggestions, ideas, feedback, or other information (“Submissions”) provided to Boomf become our sole property. We shall own exclusive rights, including all intellectual property rights, and may use and disseminate Submissions for any lawful purpose without compensation to you.

You warrant that Submissions are original or that you have the right to submit them. There is no recourse against us for any alleged infringement.

We reserve the right to:

  1. Monitor the Site for violations;

  2. Take legal action against violators;

  3. Restrict access to Contributions;

  4. Remove or disable files/content that are burdensome;

  5. Manage the Site to protect our rights and ensure proper functioning.

9. SITE MANAGEMENT

  • We may, but are not obligated to:

    • Monitor the Site for compliance;

    • Remove offensive, illegal, or problematic content;

    • Limit access or availability of the Site for operational reasons;

    • Manage technical performance and correct system issues.

    See Section 13 for Modifications and Interruptions.

 

10. PRIVACY POLICY

Our Privacy Policy https://boomf.com/privacy governs personal data.

GDPR Compliance: For EU users, data is collected and processed under GDPR standards. We transfer data internationally only in accordance with GDPR-approved mechanisms.

US Users: We comply with applicable US privacy laws, including CCPA where relevant.

11. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE AND POLICY

Boomf respects IP rights. If you believe content infringes your copyright, contact our Designated Copyright Agent.

Notifications and counter-notifications must meet DMCA 17 U.S.C. § 512 requirements.

 

12. TERM AND TERMINATION

These Terms remain in effect while you use the Site. We may, at our sole discretion, terminate or suspend access for violations of these Terms, breach of law, or other reasons without notice.

Termination bars creating new accounts or using the Site indirectly. See Section 5 for Prohibited Activities.

 

13. MODIFICATIONS AND INTERRUPTIONS

We may modify, suspend, or discontinue the Site for operational reasons without notice. We are not liable for any interruptions, errors, or downtime.

14. GOVERNING LAW

These Terms are governed by UK law. EU consumers retain mandatory rights under local law.

 

15. DISPUTE RESOLUTION

Informal negotiation is required for at least 30 days. Binding arbitration is conducted under European Court of Arbitration rules in London, unless overridden by local consumer protection laws.

 

16. CORRECTIONS

We may correct errors in pricing, descriptions, or content without notice.

 

17. DISCLAIMER

The Site is provided “as-is.” Boomf disclaims all warranties to the fullest extent permitted by law. See Section 18 for Limitations of Liability.

 

18. LIMITATIONS OF LIABILITY

Boomf’s liability is limited to amounts paid in the 1-month period before a claim. Certain jurisdictions (e.g., EU, US states) may not allow some limitations.

 

19. INDEMNIFICATION

You agree to indemnify Boomf for claims arising from your Contributions, Site use, or violation of Terms.

 

20. USER DATA

You are responsible for data transmitted to the Site. Boomf maintains backups but is not liable for data loss. See Section 10 for Privacy Policy.

 

21. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Electronic communications, forms, and signatures are binding.

 

22. CALIFORNIA USERS AND RESIDENTS

California residents may contact the California Department of Consumer Affairs for complaints.

 

23. MISCELLANEOUS

These Terms constitute the full agreement. Waivers, severability, and assignment are governed by standard contract rules.
